Acceptance of Agreement ContactThis Mold Detection Inspection Agreement ("Agreement") is entered into between K9 Mold Scouts LLC ("Company") and the individual or entity scheduling, purchasing, or receiving inspection services ("Client"). By scheduling an inspection, making payment, electronically accepting this Agreement, signing this Agreement, or allowing the inspection to proceed, Client agrees to be bound by the terms set forth below.
1. Purpose of Inspection
The purpose of the inspection is to use professionally trained canine scent detection methods, visual observations, and related inspection procedures to identify areas where mold-related odors may be present at the time of the inspection. The inspection is intended to assist the Client in determining whether additional evaluation, testing, remediation, or professional consultation may be appropriate. The inspection is not intended to certify a property as mold-free or guarantee the absence of mold.
2. Scope of Services
Services may include:
- Client consultation
- Review of known moisture or mold concerns
- Canine inspection of agreed-upon areas
- Visual observations
- Documentation of findings
- Photographs when appropriate
- Written inspection report or summary
- Recommendations for further evaluation when warranted
The inspection is limited to areas specifically agreed upon by the Client and K9 Mold Scouts LLC.
3. Nature of Canine Detection Services
The Client understands and acknowledges that:
- Detection dogs are trained to identify specific mold-related odors.
- A canine alert indicates the presence of a trained target odor.
- A canine alert is not a laboratory result.
- A canine alert does not identify mold species.
- A canine alert does not determine mold concentration.
- A canine alert does not identify health risks.
- A canine alert does not determine whether remediation is necessary.
Although detection dogs are highly trained and reliable, no canine detection system is infallible, and no guarantee is made regarding the detection of every mold condition or source.
4. Inspection Limitations
The inspection is non-invasive and limited in scope. Unless otherwise agreed in writing, K9 Mold Scouts LLC will not:
- Remove building materials
- Open walls, ceilings, or floors
- Move furniture or large personal belongings
- Enter unsafe areas
- Perform destructive testing
- Conduct laboratory sampling
- Conduct air quality testing
- Conduct moisture mapping beyond the agreed scope
The inspection is limited to areas that are safely accessible at the time of the inspection. Areas that are inaccessible, obstructed, concealed, unsafe, locked, occupied by aggressive animals, or otherwise unavailable are excluded from the inspection.
5. No Remediation, Medical, Engineering, or Legal Services
Client understands that K9 Mold Scouts LLC does not provide mold remediation, mold removal, water damage restoration, construction services, structural engineering, environmental consulting, medical advice, health assessments, legal advice, or insurance claim assistance. Any recommendations regarding remediation, repairs, testing, or health concerns should be evaluated by appropriately licensed professionals.
6. Client Responsibilities
The Client agrees to:
- Provide accurate information regarding the property.
- Disclose known water intrusion, leaks, flooding, or prior remediation.
- Provide safe and unrestricted access to inspection areas.
- Secure pets when necessary.
- Ensure utilities are operational if required.
- Notify K9 Mold Scouts LLC of any hazardous conditions.
The Company reserves the right to suspend or terminate the inspection if unsafe conditions exist.
7. Findings and Reports
Inspection findings represent conditions observed or detected at the time of the inspection only. Building conditions may change due to moisture intrusion, weather events, occupancy changes, construction activities, ventilation changes, or maintenance issues. The Client understands that future mold growth or moisture conditions may occur after the inspection. Inspection reports are intended solely for the Client and may not be relied upon by third parties without the written consent of K9 Mold Scouts LLC.
8. Fees, Travel Charges, and Payment
Payment is due according to the terms provided during scheduling unless otherwise agreed in writing. Properties located outside the Company's standard service area may be subject to a travel fee of $1.75 per mile, round trip, calculated from Santa Clara, Utah, to the inspection location and back. Travel fees are separate from inspection fees. Community Booking Discounts may be offered at the sole discretion of K9 Mold Scouts LLC and are not guaranteed.
9. Cancellation, Rescheduling, and No-Show Policy
Clients may cancel or reschedule without penalty by providing at least twenty-four (24) hours' notice before the scheduled appointment. Appointments canceled or rescheduled with less than twenty-four (24) hours' notice may incur a $75 Cancellation & Rescheduling Fee, plus any applicable travel charges. If the inspection cannot be completed because the Client is not present when required, access is denied, utilities are disconnected, unsafe conditions exist, or the property is otherwise unavailable for inspection, the appointment may be treated as a No-Show and subject to applicable fees.
10. Limitation of Liability
Client acknowledges that mold detection services involve inherent limitations. K9 Mold Scouts LLC shall not be liable for:
- Hidden or concealed conditions.
- Inaccessible areas.
- Future mold growth.
- Future water intrusion.
- Conditions that develop after the inspection.
- Errors or omissions resulting from incomplete access.
- Actions taken by contractors, laboratories, insurers, landlords, tenants, buyers, sellers, or other third parties.
- Remediation outcomes.
- Health-related claims.
- Property value claims.
To the fullest extent permitted by law, the maximum liability of K9 Mold Scouts LLC arising from any claim related to the inspection, report, or services provided shall be limited to the amount paid by the Client for the inspection.
11. Waiver of Consequential Damages
Under no circumstances shall K9 Mold Scouts LLC be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including but not limited to loss of use, loss of income, business interruption, relocation expenses, alternative housing expenses, emotional distress, property value reduction, or remediation costs exceeding the inspection fee — even if advised of the possibility of such damages.
12. Opportunity to Re-Inspect
As a condition of any claim, the Client agrees to notify K9 Mold Scouts LLC in writing of any alleged deficiency and provide the Company a reasonable opportunity to re-inspect the property before undertaking repairs, remediation, demolition, or legal action. Failure to provide such opportunity may waive any claim against K9 Mold Scouts LLC.
13. Indemnification
Client agrees to indemnify, defend, and hold harmless K9 Mold Scouts LLC, its owners, employees, contractors, canine handlers, and affiliates from claims, damages, liabilities, costs, and expenses arising from inaccurate information provided by the Client, unsafe property conditions, Client misuse of inspection findings, third-party reliance on inspection reports, or violations of this Agreement.
14. Force Majeure
K9 Mold Scouts LLC shall not be liable for delays, cancellations, or inability to perform services resulting from events beyond its reasonable control, including severe weather, road closures, natural disasters, illness, canine health concerns, equipment failure, governmental actions, or other unforeseen circumstances.
15. Governing Law and Venue
This Agreement shall be governed by the laws of the State of Utah. Any dispute arising from this Agreement shall be brought exclusively in the state or federal courts located in Washington County, Utah.
16. Severability
If any provision of this Agreement is determined to be unenforceable, the remaining provisions shall remain in full force and effect.
17. Entire Agreement
This Agreement, together with the Company's Terms of Service and Privacy Policy, constitutes the entire agreement between the parties regarding the inspection services provided.
18. Acceptance of Agreement
By signing this Agreement, scheduling an inspection, making payment, electronically accepting this Agreement, or allowing the inspection to proceed, the Client acknowledges that they have read, understood, and agree to all terms and conditions contained herein.
