Terms of Service

Welcome to K9 Mold Scouts LLC ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to our website and your use of our canine mold detection inspection services. By scheduling an inspection, using our website, or purchasing our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Scope of Services

K9 Mold Scouts LLC provides professional canine mold detection services only. Our trained detection dogs identify areas where mold-related odors may be present based on the conditions existing at the time of the inspection. Services may include:

• Residential mold detection
• Commercial mold detection
• Vehicle and RV mold detection
• Recreational property inspections
• Post-remediation verification inspections
• Moisture concern investigations
• General mold odor source identification

Our inspection is a non-invasive visual and canine-assisted detection service unless otherwise agreed in writing.

Detection Services Only

K9 Mold Scouts LLC does not provide:

• Mold remediation
• Mold removal
• Water damage restoration
• Demolition
• Construction repairs
• Structural engineering
• Environmental consulting
• Laboratory testing or sample analysis
• Medical advice
• Legal advice
• Indoor air quality certification

Our inspection is intended solely to assist clients in identifying potential mold-related concerns and determining whether additional evaluation or remediation by qualified professionals may be appropriate.

Inspection Limitations

Our inspections are limited to areas that are safely accessible at the time of the inspection. We do not move furniture, appliances, stored belongings, flooring, drywall, insulation, ceiling materials, or other building components. Hidden, concealed, obstructed, inaccessible, or unsafe areas are excluded from the inspection. Because mold conditions may change due to moisture, weather, construction, occupancy, or other environmental factors, inspection findings represent conditions only at the time of the inspection.

No Guarantee

Although our detection dogs are professionally trained and highly reliable, no inspection method can detect every mold condition. K9 Mold Scouts LLC makes no representation or warranty that:

• A property is free of mold.
• Every mold source has been identified.
• Mold will not develop after the inspection.
• Future water intrusion or microbial growth will not occur.

Inspection results should never be interpreted as a guarantee of future conditions.

Client Responsibilities

The client agrees to:

• Provide complete and accurate property information.
• Provide safe and unrestricted access to all requested inspection areas.
• Disclose known water damage, flooding, leaks, remodeling, or remediation history.
• Secure pets before the inspection.
• Ensure utilities are operational when necessary.
• Inform K9 Mold Scouts LLC of any hazards or unsafe conditions.

Failure to provide safe access may prevent completion of the inspection.

Scheduling, Payment & Travel Fees

Payment is due according to the terms provided during scheduling unless otherwise agreed in writing. Our standard service area includes St. George, Washington, Santa Clara, and Ivins. Properties outside our standard service area are subject to a travel fee of $1.75 per mile (round trip) calculated from our service location in Santa Clara, Utah, to the inspection property and back. Travel fees compensate for travel time, fuel, vehicle expenses, and scheduling availability.

Community Booking Discount

When multiple inspections are scheduled in the same community on the same day, K9 Mold Scouts LLC may waive applicable travel fees at its sole discretion. This discount is based on confirmed appointments and scheduling availability and is not guaranteed.

Cancellation & Rescheduling

Clients may cancel or reschedule without penalty by providing at least 24 hours' notice before the scheduled appointment. Appointments canceled or rescheduled with less than 24 hours' notice may incur a $75 Cancellation & Rescheduling Fee, in addition to any applicable travel charges already incurred or reserved. Appointments where inspectors are unable to complete services due to denied access, unsafe conditions, disconnected utilities, excessive contamination, aggressive animals, or client absence will be treated as a No-Show. Emergency situations are considered case by case, and K9 Mold Scouts LLC reserves the right to waive fees at its discretion.

Inspection Reports

Inspection reports are prepared exclusively for the client identified in the inspection agreement. Reports are intended solely for informational purposes and should not be interpreted as engineering reports, environmental assessments, remediation plans, or guarantees regarding the condition of the property. Inspection reports may not be reproduced, modified, distributed, or relied upon by third parties without the prior written consent of K9 Mold Scouts LLC.

Intellectual Property

All inspection reports, photographs, graphics, logos, website content, inspection methodologies, written materials, and other intellectual property remain the exclusive property of K9 Mold Scouts LLC unless otherwise stated.

Limitation of Liability

K9 Mold Scouts LLC provides professional canine mold detection inspections based upon conditions existing and accessible at the time of inspection. To the fullest extent permitted by law, K9 Mold Scouts LLC shall not be liable for:

• Hidden, concealed, inaccessible, or unsafe conditions.
• Mold growth occurring after the inspection.
• Moisture intrusion occurring after the inspection.
• Decisions made by clients, contractors, insurers, buyers, sellers, landlords, tenants, or third parties.
• Remediation performed by others.
• Laboratory analysis performed by others.
• Property damage unrelated to the inspection.
• Health effects allegedly associated with mold exposure.
• Lost profits, relocation expenses, business interruption, emotional distress, diminished property value, or other indirect, incidental, special, punitive, or consequential damages.

The maximum liability of K9 Mold Scouts LLC for any claim arising from the inspection shall not exceed the total amount paid by the client for the inspection services.

Indemnification

The client agrees to indemnify, defend, and hold harmless K9 Mold Scouts LLC, its owners, employees, contractors, canine handlers, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from the client's misuse of inspection reports, inaccurate information provided by the client, unsafe property conditions, or violations of these Terms.

Force Majeure

K9 Mold Scouts LLC shall not be responsible for delays or inability to perform services resulting from circumstances beyond our reasonable control, including severe weather, natural disasters, road closures, illness, equipment failure, canine health concerns, governmental actions, or other unforeseen events.

Governing Law

These Terms shall be governed by the laws of the State of Utah without regard to conflict of law principles. Any dispute arising from these Terms or the services provided by K9 Mold Scouts LLC shall be brought exclusively in the state or federal courts located in Washington County, Utah.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with any signed inspection agreement and our Privacy Policy, constitute the entire agreement between the parties regarding the services provided by K9 Mold Scouts LLC.

Changes to These Terms

We reserve the right to update these Terms at any time. Updated versions become effective immediately upon posting on our website.
